Terms of Service

These Terms outline your responsibilities, how Mackenzie\'s ASL Toolkit operates, and how ASL content may support AI training unless you opt out.

1. Acceptance of Terms

  • Mackenzie's ASL Toolkit ("Services") is provided by Mackenzie Learning Labs, Inc. By creating an account, uploading content, or continuing to use the Services, you agree to these Terms of Service and all policies referenced here.
  • If you are using the Services on behalf of another person or organization, you confirm that you have authority to bind them and that they accept these Terms. If you cannot agree, do not access the Services.

2. Eligibility and Account Responsibilities

  • You must be at least 13 years old (or the minimum age in your jurisdiction) to create an account. Minors should only use the Services under the supervision of a parent, guardian, or educator.
  • Safeguard your credentials and immediately notify us of unauthorized access. You remain responsible for activity that occurs under your account.
  • Provide accurate information and keep it current so that we can contact you about product updates, policy changes, or data preferences.

3. User Content and License Grants

  • You retain ownership of the videos, audio, text, images, and other content you submit ("User Content").
  • By uploading User Content, you grant Mackenzie Learning Labs a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, analyze, modify, perform, display, publish, translate, and create derivative works from that content as needed to operate, maintain, secure, promote, and improve the Services.
  • This license allows us to annotate and transform User Content, including ASL videos and accompanying metadata, to build practice materials, moderation tooling, analytics, or accessibility features.
  • You represent that you have all permissions needed to share the User Content and that it does not infringe or violate the rights of others.

4. AI Training and Opt-Out Choices

  • High-quality ASL videos, motion data, captions, and reports help us train, evaluate, and audit sign-recognition and translation models. Unless you opt out, you agree that we may use your User Content and related metadata to develop current and future AI features, including via third-party platforms such as Google Cloud Vertex AI or Genkit.
  • You can opt out of model-training use at any time by visiting Profile > Settings > Privacy (or the equivalent control when signed in) or by emailing us at support@mackenziesasl.com. We will flag your account and exclude future uploads from training pipelines, while retaining minimal data needed to provide the core Services.
  • Even if you opt out, we may continue to process content as reasonably required to deliver the product, enforce policies, meet legal obligations, or maintain security. Opting out may limit personalization or experimental AI features.

5. Privacy and Data Protection

  • Our Privacy Policy explains what personal data we collect, how we use it, and the rights you have. By using the Services, you acknowledge that processing, including transfers to the United States and other countries where we or our providers operate, will occur.
  • We implement administrative, technical, and physical safeguards designed to protect your information, but no system is perfectly secure. You agree to use caution when sharing sensitive data with other users.

6. Acceptable Use

  • Do not upload unlawful, abusive, discriminatory, or infringing material, nor content that depicts others without their consent.
  • Do not interfere with service stability, attempt to reverse engineer our systems, mine other users' data, or use automated tools that exceed documented API limits.
  • Respect classroom, cohort, or community guidelines that may apply to organized learning spaces hosted on the Services.

7. Third-Party Tools and Integrations

  • The Services rely on providers such as Firebase, LiveKit, and Google Cloud for authentication, storage, streaming, analytics, and AI workflows. Your use of those features is also subject to the providers' terms.
  • Links to external resources or partner content are provided for convenience and do not imply endorsement. We are not responsible for how third parties handle your information once you leave our environment.

8. Suspension or Termination

  • We may suspend or terminate access immediately if you breach these Terms, harm other users, jeopardize the Services, or if required by law or governmental request.
  • You may delete your account at any time. Some content (for example, anonymized analytics or backup copies) may persist for a limited period consistent with our Privacy Policy and backup practices.

9. Disclaimers and Limitation of Liability

  • The Services are provided "as is" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
  • We do not guarantee uninterrupted or error-free operation, nor outcomes from learning activities or AI-powered feedback.
  • To the fullest extent permitted by law, our total liability for claims arising out of or relating to the Services is limited to the greater of (i) amounts you paid us in the six months before the claim or (ii) USD $100. Some jurisdictions do not allow such limitations, so they may not apply to you.

10. Changes to These Terms

  • We may update the Terms to reflect new features, regulatory requirements, or security practices. Material changes will be announced via in-product notice or email before they take effect.
  • Continued use of the Services after new Terms become effective constitutes acceptance of the updates.
